New Home Buyers Avoid Extra Charge

This Letter is Pretty Lengthy but it tells the story in detail!!

I will not Lie, Cheat or Steal! Those were the first words out of our Salespersons mouth, when we first stepped into a New Homes Contruction in Florida. My husband and I were looking to buy our first home and the experience we went through will absolutely shock you.

  • It's about the middle of January 2001

    and we begin our buying process with a Builder a New Homes Contruction in Florida. A $1000 down and you can own your own home and land. We sat down with our Salesperson Stephanie Cook and again she starts the conversation with "I will not Lie, Cheat or Steal" to make a sale. I want my customers to be completely satisfied and happy when they buy their new home. The Salesperson goes over all the details about the home and what comes with the home.

  • The Salesperson has already pulled both my husbands credit

    and my credit and according to The Salesperson it's great! No problems! We're excited, we've never heard that before. We tell them that we still have 2 more months on our lease and The Salesperson tells us "Oh no problem we can buy you out of that easily" So we chose our house and gave them our $1000 deposit. It's now the first week in February and we've gone up to Builder New Homes' office numerous times to go over what we want in our home and where we want our home.

  • So far things are going great.

    We now tell her what kind of decks we would like outside our home, "Oh no problem, this will only cost a couple of thousand dollars more and that would be may $20 more on your monthly mortgage", so we tell her what kind of decks we want. We take another look at the house we chose and notice there are not phone outlets...We ask the Salesperson about the outlets and she tells us that there will be outlets installed when the house is moved to the land. So now that we've gotten everything straightened out, Stephanie faxes our apartments to get the amount it will be to buy us out of our lease and we deliver the paper work ourselves to Yhe Salerperson.

  • A couple of days go by, The Salerperson

    calls us and says they have to roll my Jeep over onto the Mortgage so it will look like we have more income. They go back and forth with the Mortgage Company and they tell us they were able to get my whole Jeep payment of $11,000 added to the Mortgage. It's now time to do the Preliminary Closing (we have to do three Closings, one with Crown, one with the Land people and then the Final Closing). We are now speaking with the Manager of HomeBuilder. He goes over all the details and numbers. He tells us this is only for the home portion and the Jeep Payment will not show up until the final closing.

  • They sold us the home for $51,000 and we put $1,000 down so we owed $50,000.

    So far, so good. Now I ask about the decks and the Manager looks at us with confusion and says "No the decks will be extra". We tell him that The Salesperson told us she would take care of that. He calls The Saler into the office asks her about the decks and she has a confused look on her face and says "Oh I haven't called the deck people yet" the Manager calls the deck people, gets a price, gets off the phone and tells us that "He's gonna have to eat this one" he'll be taking care of the decks at no extra charge to us. Then we ask him about our lease. Again The Salerperson says "Oh, I didn't figure that in to the mortgage" and the Manager tells us they can't buy us out of our lease that by law if you are buying a house your apartment complex must let you out of your lease. So we take his word for it. Big Mistake! We come back a couple of days later to sign the revised papers with the same price of $51,000, which includes the decks. Next we go to sign for the land, that went very smoothly!

  • The HomeBuilder tells us

    we will do the Final Closing by February 25th and be able to move in by the 28th of February. We have already turned in our notice at the apartment. It's now the 20th of February and Crown has assured us that we will close on the 23rd. The 21st of February an Appraiser calls me and asks me a bunch of questions. I asked her if they had already appraised the house, they said no.The HomeBuilder told me they had to appraise the home before they could even consider putting my Jeep on the Mortgage cause they had to appraise the House and Land for enough money to include the Jeep. I call the Builder Manger and ask what the deal is, he said the Appraiser should of never called me and that something fell in between the cracks. So he calls the Appraiser tells the Appraiser that I was furious at them for calling me.

  • I called the Appraiser back

    and told them I said no such thing, that I was upset at Builder Manager for lying. The Appraiser told me my name never came up in the whole conversation and that HomeBuilder's Manager yelled at them for calling me. So the Homebuilder's manager lied about that. I call the manager back and ask him about the Jeep and he tells me he's 99.9% sure they will get the whole Jeep onto the mortgage. So now I am stressing out cause my Jeep payment was due on the 12th of February and it will go on the report that I am late on the 12th of March. It's now the 26th of February and still no closing, the Mortgage people are having difficulties with the Underwriters.

  • The underwriters

    are now calling me questioning me about certain things on my credit report. Shouldn't they of already done this when they were approving me? So now I am stressed out again. It's now the 29th of February, still no closing.

    We go to homebuilder and tell the manager that they promised us time and time again we would be out of our apartment by the end of this month and now we have put our notice in and we still haven't closed. He gives us a key to the home and lets us move in before closing. We move in and there's no electric, the septic tank is not hooked up right and the a/c and heat aren't hooked up either. We spend the first night at the home with no heat and only a butane fish fryer to keep us warm. Next day still not electric, Crown promises us someone will be out there to hook it up. We spend the 2nd night with no electricity. My husband is an electrician and the materials were out there.

  • The Land people tell us to go

    ahead and hook it up ourselves. This entails pulling wire, cutting wire, cutting pipe, crawling under the house, which that is how we found out the septic tank was not hooked up correctly and driving a 10 foot ground rod into the ground near our house. My husband and I did this ourselves, also including paling out water from the ditch they dug to install the electric,which it rained and filled up the ditches. We hook up our electric; we hook up our a/c and heater and hook up the electric to our septic tank. The Land people pay us $100 for doing all the work. Homebuilder's response was "Well they got paid for doing it, so why are they complaining?" We now go to get ice out of our fridge, the water is not hooked up to the fridge and they bolted the fridge to the wall and stripped the bolt. It takes us two hours to get the bolt out of our wall, which included making a hole; we then hook up the water and the pipe leaks.

  • We call Homebuilder,

    the salesperson informs us that the manager made the comment of "They're home owners now, they should be able to fix that themselves." We haven't even Closed yet. FINALLY we close on the 14th of March. FINALLY it's all over with. The 15th of March after the closing, after the signing, the mortgage company calls and tells us Homebuider did not send enough money for the Jeep payment and they were only paying $6,700 out of $11,100 and we had to make the rest of the payments. We call Homebuilder and the mangager tells us that there were some last minute closing costs that they had to pay and they didn't know about it till after the close, so the money they sent over had to be split in between the car and closing. Ok well the closing costs they said they had to pay was $5,000.

  • The home jumped from $51,000 to $68,000

    and plus there was ""Family Gift" of $11,600 that was on the contract. $68,000 + $11,600 = $79,600 Ok minus $51,000 for the home, $5000 for the closing and $6700 for the Jeep that = $5,300. Where is that money??????? Well did we really get our decks for free? And why didn't they know about the unexpected closing costs before we signed? Oh and top this all off our apartment complex said there was no law they had to let us out of our lease if we were buying a house, so now we have to come up with $1300. We have been royal taken for and this can not go unnoticed.

    All we want is the rest of our Jeep to be paid off. We'll have to over come all the lies told to us, the manual labor we had to do, which should of never of happened and the stress we have gone through. I know it is normal for stress to happen when buying a home but it should never happen after the Closing. Some HomeBuilder new Homes not be in business and they do not know how to handle customers correctly. We know for a fact that they asked someone there to forge a 1999 W2 form to get them approved.
